Terms of Use

Limited Liability Company "OTILIE", registration No. 40103172953, address: Rīga, Blaumaņa iela 8-3, LV-1011, hereinafter – the online store – provides the content available on the website and offers goods/services in accordance with the Terms of Use outlined below.

  1. General Terms

If the consumer purchases goods/services through the website, such a mutual agreement is considered a Distance Contract and is subject to the legal norms of the Republic of Latvia that regulate distance contracts, including, but not limited to, the Republic of Latvia "Consumer Rights Protection Law", the Republic of Latvia Cabinet of Ministers Regulations "Regulations on Distance Contracts", etc.

  1. Making Purchases

Prices and specifications of products sold in the online store are indicated next to the products.

To place an order, add the desired products to the shopping cart. Fill in all required fields and choose the most suitable delivery method. The total cost of the order with delivery will then be displayed on the screen. Complete the payment for the purchase to finalize the order.

  1. Payment Terms

The currency for payments on the website is Euro. Purchases can be paid for by choosing the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:

Add the payment methods that your online store will use:

  • Latvian internet bank payments: Swedbank, SEB, Citadele and Luminor
  • Visa/Mastercard card payments

NB! When using the internet banking payment method, confirm the order and click the "Return to merchant" button.

Personal data required for payments are transferred to the licensed payment institution Maksekeskus AS.

The contract comes into effect upon successful payment to the online store's bank account. If for any reason the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than within 14 days after receiving the notification.

  1. Delivery Terms

Goods are delivered to the following countries: Latvia. Purchased goods are delivered using: parcel locker partner, courier service, pick-up from store. All fees and taxes to be paid to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are shown before confirming the order. Purchased goods are delivered to the Buyer's specified receiving location within 3-10 business days, depending on where in Latvia the goods are ordered. An exception is furniture orders, which take 8 to 12 weeks from the order placement.

  1. Right of Withdrawal

The Buyer has the right to withdraw from the goods within 14 calendar days from the moment of receiving the Goods. (Depending on the product, the buyer may not have mandatory withdrawal rights; in such a case, the reason must be clearly stated and explained). The right of withdrawal is not applicable if the Buyer is a legal entity.

To exercise the 14-day right of withdrawal, the goods may only be used for their intended purposes, the consumer is responsible for maintaining the quality and safety of the goods during the period of exercising the right of withdrawal. If the goods are used improperly or damaged, if used carelessly during use or not following instructions, if the original packaging of the goods is lost, or if its packaging is significantly damaged, the online store has the right to reduce the refund amount in accordance with the decrease in the value of the goods.

To exercise the right of withdrawal, you must submit a withdrawal form, which can be found here: withdrawal form by sending it to the email address otilie@otilie.lv within 14 days after receiving the goods.

The Buyer covers the costs of returning the goods, except in cases where the reason for return is that the goods do not comply with the order (e.g., incorrect or damaged product).

The Buyer is obliged to return the Goods to the Seller without delay, but no later than 14 days after sending the withdrawal form to the online store. After receiving the returned goods, the online store will promptly, but no later than within 14 days, refund all payments received from the buyer based on the Distance Contract.

The Seller has the right to withhold payment until the Goods or proof of return of the goods has been received from the Buyer. If the buyer has chosen a shipping method other than the cheapest shipping method offered by the online store, the online store is not obliged to compensate for the excess shipping costs.

The online store is not responsible for delays in the fulfillment of obligations or their non-fulfillment, or other types of non-fulfillment caused by circumstances and obstacles beyond the online store's reasonable control.

The online store reserves the right to refuse to sell goods and demand their return from the Buyer if the price indicated in the online store is significantly lower than its market price due to an error.

  1. Consumer Rights for Non-Conforming Goods

The online store is responsible for non-conformities of goods sold to the Buyer with the contract terms or defects that arose within 6 months after the delivery date to the customer, or were present at the time of delivery, if such an assumption does not contradict the characteristics of the item or the defect. The Buyer must inform the Seller about non-conformity of goods immediately, within 2 months after discovering it, i.e., submit a complaint. The Buyer can submit a complaint by contacting the online store, writing to otilie@otilie.lv

The online store is not responsible for defects that arose after the delivery of goods to the Buyer. If the purchased goods have defects for which the Seller is responsible, the Buyer has the right to demand the elimination of the defects or exchange for new goods free of charge.

If the goods cannot be repaired or replaced, the Seller refunds all payments provided for in the Distance Contract to the Buyer. The Seller provides a written response to the consumer's complaint within 15 days.

  1. Processing of Buyer's Personal Data

The online store processes only the personal data entered by the buyer when ordering goods, such as name, surname, email, etc.

The online store transfers personal data to transport service provider/s to ensure the delivery of goods.

If you have explicitly agreed to receive our marketing communications, including newsletters, we may occasionally contact you with information about our services and the latest offers. For this purpose, we may process your email address that you provided when signing up for marketing communications. The Buyer has the option to opt-out of marketing communications by notifying us at otilie@otilie.lv

  1. Dispute Resolution Procedure

In matters not stipulated in these terms and conditions, the Buyer and the Seller undertake to comply with the normative acts in force in the Republic of Latvia.

The parties shall resolve all disputes arising between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute cannot be resolved through negotiations or correspondence, the parties shall resolve the dispute in a court of the Republic of Latvia, observing the normative acts of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller can be submitted for resolution to the Consumer Rights Protection Centre or a court of the Republic of Latvia.

The Buyer also has the right to apply to the European Union dispute resolution institutions.
